OMB hearing in September as local developer appeals decision by Municipality of Kincardine
A local developer is appealing a planning decision by the Municipality of Kincardine, and a two-day Ontario Municipal Board (OMB) hearing has been slated for Sept. 27-28, at the Kincardine municipal administrative centre.

The applicant and appellant is 2459825 Ontario Inc., which brought forward a zoning amendment in March of this year, to permit a residential development at the corner of Kincardine Avenue and Fraser Drive, Kincardine. Council turned down the application.

At that planning meeting, March 8, council heard from Bruce County planner Mollie Kuchma who outlined the developer's revised plan for the property, which took into account concerns and comments from the public meeting held in January.

The revised application called for rezoning to R3 from R1, to allow for the construction of a five-unit row townhouse dwelling along the north side; as well as a detached accessory structure (four-bay garage), and a semi-detached dwelling unit on the south side adjacent to Kincardine Avenue.

It contained fewer dwelling units than the plan presented in January, reduced to seven from 10, with relief sought from the required minimum lot frontage for the townhouses and the semi-detached dwelling. No secondary suites would be permitted in the semi-detached units on the south side.

The planner recommended approval, saying the application was consistent with the Provincial Policy Statement, upheld the objectives of the Kincardine Official Plan, and represented good land-use planning.

However, council was not convinced and rejected the application.
